The amount of condo fees currently includes a special amount to comply with the new law requiring a self-insurance fund which will become mandatory on April 15, 2022 for all condo buildings.
Our syndicate of co-owners was far-sighted and did not wait to distribute the amount over several months. The special amount is payable monthly until fiscal year 2021-2022. At that point, the self-insurance amount will be complete and condo fees will decrease.
For your information: The Self-Insurance Fund will become mandatory on April 15, 2022 following the adoption of the Bill 141, in 2018, which notably created section 1071.1 of the Civil Code of Québec. It had become necessary due to a substantial increase in insurance deductibles. Most of the time, the amount of these deductibles was formerly negligible, whereas today, it can reach tens, even hundreds of thousands of dollars.
The condominium associations that will not have collected this amount before April 15, 2022 will have to ask each owner to pay the entire special amount in a single payment to comply with the new law.
